Yes: since July 1, 2023, the Work and Family Mobility Act lets Massachusetts residents apply for a standard driver's license (Class D for cars, M for motorcycles) regardless of immigration status. You still prove your identity and date of birth, your Massachusetts residency and your Social Security status, and pass the RMV tests. Source: the RMV's official WFMA page.
1. What the law changed
Before, the RMV required proof of lawful presence in the U.S. The WFMA removed that requirement for the standard license only. You must still prove who you are, your date of birth, your Social Security status and that you live in Massachusetts. Rules for REAL ID, Mass ID and commercial licenses (CDL) did not change.
2. Identity and date of birth
The RMV asks for two documents from different lists. Examples the RMV accepts: a valid foreign passport or a consular ID on the first list; on the second, a foreign driver's license, a foreign national ID card, a birth certificate or a marriage certificate, among others. Every document must be original and unexpired — no photocopies or phone pictures. Documents not in English need a certified translation. Check the current full list on the RMV site before you go.
3. Social Security
You can present your SSN, a denial letter from the Social Security Administration, or sign the affidavit of no SSN, depending on the identity documents you bring.
4. Massachusetts residency
Bring proof that you live in Massachusetts (for example a utility bill or a lease). The number and types accepted are on the RMV list.
5. The tests
- Book an appointment with the RMV.
- Vision screening.
- Learner's permit knowledge test.
- Road test.
The standard license is valid for 5 years.
6. What the license lets you do (and what it doesn't)
You can drive legally, register a car in your name and get car insurance. It is not a REAL ID: it cannot be used as federal identification, for example to board a domestic flight.
7. With the license, you can buy and finance a car
With a Massachusetts license you can pay cash or finance — including with an ITIN, subject to credit approval. See also how to buy a car without a Social Security number, the first-time buyer guide and our insurance and registration guide.
